Pursuing an Analysis-driven Theorization of the Philosophy of Law: To Shape the Analytical Character of Chinese Jurisprudence

分析性是理论研究的基本要求,但对于法理学来说,分析性品格却有着更为深层的意义。首先,法理学追求法律实践的根本性之"道",对基本概念的理论清晰性有着更高的要求,分析性作为一种具有工具意义和建构意义的理论探究之"器",有助于展示法理学概念的复杂结构。其次,法理学对法律作为一种价值性制度实践的本质有更整全的揭示和挖掘,分析性有助于厘清法律背后的价值网络的基本结构,为部门法研究提供价值论证意义上的支持。最后,法理学之方法论问题越来越呈现出其元理论内涵,而分析性是确立法理学之方法论立场的必要工具。中国法理学承担着理论建构和回应法律实践之难题的双重使命,分析性品格有助于强化其实现该使命的力量,在法理学之不同理论立场之间寻求一种妥当的对话方式。

No theorization can be separable from rigorous and detailed analysis. But when it comes to jurisprudence, the analytical character of theorization is comparatively more significant. Firstly, jurisprudence studies pursue the basic principle governing the legal practice, thus imposing greater needs for the theoretical exactness of the core concepts. Rigorous and in-depth analysis, as a tool for discovering and building legal theories, helps display the complex structure of jurisprudence. Secondly, since jurisprudence can better reveal the essence of law as a practice of axiological institutions, sound analysis can help display the basic structure of the value network behind law, thus offering an axiological support for the research on specific branches of law. Lastly, the more methodological discussions on jurisprudence we have, the clearer its meta-theoretical implications become, and the development of the analytical character of jurisprudence is the necessary tool for improving its methodology. It is the mission of Chinese jurisprudence to construct legal theories and to address the problems arising from legal practice. The development of the analytical character of jurisprudence can help achieve this goal and enable a productive dialogue between different theoretical strands.
