Chinese National Law: Problem Direction, Regulated Collection and Field Returning

民族法学是一门介于法学与民族学之间的交叉性学科。中国学者在对其进行研究时沿袭了规范主义研究范式,对内生理论的探寻存在着先天不足。放眼未来,问题导向、规范集成与回归田野构成了制约中国民族法学发展的三重因素。因此,这三重问题理应得到中国民族法学界的理论关怀与精准回应。问题导向,所要谋划的是中国民族法学活动场域的空间架构;规范集成,所要研讨的是中国民族法学学科属性的定夺;而回归田野,则是对中国民族法学未来发展面向的方法论解构。

Chinese national law is an interdisciplinary subject between jurisprudence and Ethnology. In the study, scholars have followed the paradigm of normative research, and there is a deficiency in the exploration of its own endogenous theory. Looking forward to the future, research field, field law and field investigation, constitute the three factors that restrict the development of Chinese national law. Therefore, the three problems should be obtained from the theoretical concern and accurate response of the Chinese national law community. Research field, is the spatial structure of the field of national legal activities in China. Field law will be discussed in terms of the attribution of the attributes of the Chinese national law discipline. And field investigation is an integral deconstruction of the future development of Chinese national law.
