论互联网·餐饮外卖视角下的劳动法治——以青海省西宁市为样本

On the Labor Law Under the Internet+ Catering Platform

互联网技术使得劳动关系变得越来越灵活,就互联网+餐饮平台而言,涉及外卖、外卖站、餐饮业主、外卖配送员和客户等主体之间的利益博弈,这些主体之间的权利、义务和责任配置,似乎只能遵循"规范与促进并重"、"保护与效率并重"、"灵活与安全并重"的双重目标,才能有利于劳动关系的和谐稳定。本文作者走访了美团外卖在西宁市的配送站负责人和外卖配送员,目的是厘清外卖配送员劳动权利保护的缺失,并进而提出法律之对策。

Internet technology makes the labor relations become more and more llexlble. In terms oI ln-ternet＋catering platform,involves the interest game between the main body, such as take-out, restaurant owners, take--away and consumers, between them the rights and obligations and responsibilities of config-uration, can only seem to follow the ＂standard and promote＂, ＂protection and the dual goal of efficiency＂ and ＂flexible and safe＂ ,which can be beneficial to the harmonious and stable labor relations. In this paper, the author visited Meituan take-out in xining head distribution station, and take away, the purpose is to clarify the take-away marki, lack of labor rights protection,and and then put forward the legal counter-measures.
