A Study on the Transformation of Internal Legal Mechanism in the Context of Sharing Economy

共享经济的互动模式下所包含的内部法律关系实质上分为两类,一是供货方和租用方之间存在的平等关系,二是建立在平台和供需双方之间的管制体系。共享经济背景下的市场交流机制和信用机制必然会随着商业模式的变动而变动。因此,内部法律机制应完善具有法律效用的劳动合同,实现法律保护,在法律关系、内部法律监管关系和道德约束三方面实现内部法律机制的转变。

The internal legal relationship in the sharedeconomic interaction model is actually divided into two kinds： one is equality relationship between supplier and leasing; the other is the control system built on the platform and between supply and demand. Under the background of sharing economy, market exchange mechanism and credit mechanism will inevitably change with the change of business model. Therefore, internal legal mechanism should perfect the labor contracts with legal effectiveness and realize legal protection. The transformation of internal legal mechanism can be made in terms of legal relationship, internal legal regulation relationship and moral constraints.
