社会治理视角下日本行政型ADR之合理构建

The Rational Construction of Japan's Administrative ADR from the Perspective of Social Governance

日本行政型ADR对于弥补诉讼资源短缺、稳固国家法治根基,预防与化解社会矛盾、提高政府社会治理能力都发挥了极为重要的作用。当前我国正处于社会转型的关键时期,社会矛盾纠纷叠加、频发,预防与化解社会矛盾纠纷的工作机制正面临着巨大挑战。为了充分满足现实社会中日趋膨胀的纠纷解决需求、推动争议纠纷获得实质性解决,可以借鉴日本行政型ADR的发展经验与构建逻辑,推动我国政府职能转变,激发行政调解制度优势,创新与优化行政机关可提供的纠纷解决服务,推进多元化纠纷解决机制不断向前发展,加快全面推进依法治国总目标的实现。

Japan＇s administrative ADR has played an extremely important role in remedying the shortage of litigation resources,stabilizing the country＇s rule of law,preventing and resolving social conflicts,and improving government＇s ability to manage society.At present,China is in a critical period of social transformation.Social contradictions and disputes are superimposed and frequently distributed.The working mechanism for preventing and resolving social conflicts and disputes is facing enormous challenges.In order to fully meet the growing needs of dispute resolution in the real world and promote substantive settlement of disputes,we can learn from the development experience and the logic of administrative ADR in Japan,promote the transformation of government functions,stimulate the advantages of administrative mediation,and innovate and optimize administration.The dispute resolution services provided by the agencies will continue to advance the development of diversified dispute resolution mechanisms and accelerate the overall realization of the general goal of governing the country according to law.
