论法治评估在党的廉政建设中的实践作用

The Practical Value of the Law and Rule Evaluation on the Construction of the Incorruptible Party

党的廉政建设法治化是现代国家治理的必然趋势。通过法治评估发现、解决廉政问题,完善法治体系,开拓法治评估对党的廉政建设的实践应用新领域,以法治评估三个向度的作用助力党的廉政建设。对于学界关注颇热的法治评估机制问题,为克服社会方数据来源障碍与政府评估利益自顾的体制弊端,须建立以中央文件精神指导、上级国家机关委托、第三方组织执行、监察部门监督的混合机制,称为法治评估的"双轮一轴"模式。同时引入经济学"实证效用"这一术语,旨在实现法治评估的科学化和实证化,助力法律法规完善,最终在全社会共同努力下换来海晏河清、乾坤朗朗。

To legalize the construction of an incorruptible Party is an inexorable trend of national governance in modern society.The integrity issues should be found and solved by evaluation on the rule of the law.The law system is be perfected,new areas for the integrity construction to be carried out should be opened up and the integrity construction should to be promoted under the three dimensions of evaluation on the rule of the law in China.As to the legal evaluation mechanism paid close attention to by academic circles,the double round and one axis pattern is proposed taking the central documents in China,which is a hybrid mechanism committed by the superior national agency,implemented by a third party and supervised by the supervisory department,in order to overcome the obstacles of social data sources and evaluate shortcomings of the self-care interest mechanism adopted by government evaluation.Meanwhile the term of empirical utility used in economics is introduced,to produce a scientific and evidence-based legal evaluation,complete the rules and laws,and eventually,mold a clean party and government,a stable society,and a harmonious China.
