摘要
供应链背景下维护外派劳动者合法权益的一个重点是关注跨境供应链治理的追责机制。在信息技术时代,应将用人单位维护外派劳动者合法权益的效果作为供应链金融投资风险评价指标,这既能兼顾供应链治理追求营利的商事特征,又能弥补传统的追责机制在实践操作层面的不足;应当确立预防式、监管式、奖励式的供应链治理理念,将供应链金融投资额度与维护劳动者合法权益的效果结合起来;另外,应将外派劳务的信息纳入供应链治理中,将维权指数设为融资企业的风险评价指标并建立相关应急机制来保护用人单位。
On the background of the supply chain, one of the major projects to maintain the dispatched laborers" legitimate interests is to pay enough focus on the accountability mechanisms in supply chain management. During the era of information technology, it is necessary to put the effect of how the employer maintains the dispatched laborers" legitimate interests as a risk assessment index in supply chain finance. On one side it can give consideration to the commercial characteristics of pursuing profits in supply chain management, and on the other side it can make up the weakness of traditional accountability mechanisms on a practical level. We should establish the idea of supply chain management in preventive, supervised and promotive styles, which can unite the investment lines in supply chain finance and the effects of maintaining the dispatched laborers" legitimate interests. Moreover, we should bring dispatched laborers" information into supply chain management, set the index of protecting rights as a risk assessment indicator of financing enterprises and establish relevant emergency system to protect employers.
