生态文明视野下多元协同治理的法律思考——以福建省为例

Legal Analysis of Multivariate Collaborative Governance from the Perspective of Ecological Civilization——Taking Fujian Province as an Example

随着生态环境危机日益严重,生态文明建设已成为社会可持续发展的必然选择。对于中国环境治理而言,如何转变传统的政府主导治理模式,建立多元主体协同治理的机制是当今社会面临的重大课题,探索积极有效的协同治理模式已成为理论和现实的迫切要求。通过对福建省多年的生态文明建设经验进行总结,正视我国多元协同治理面临的法律障碍,分别从政府职能的重构、法律体系的建设、公众参与法律机制的完善和公民意识的提升四个方面提出相应的完善建议,打造促进多元协同治理的法律保障制度。

As the ecological environment crisis becomes more and more serious, the construction of ecological civiliza- tion has become an inevitable choice for the sustainable development of society. For China＇s environmental governance, how to change the traditional government dominated governance model and establish the mechanism of multi subject synergistic governance is a major issue facing today＇s society. It has become an urgent requirement for the theory and reality to explore the active and effective cooperative governance model. Through summing up the experience of ecological civilization con- struction in Fujian province for many years, we should face up to the legal obstacles faced by China＇s pluralistic collaborative governance. Put forward the eolTesponding suggestion from four aspects： the thnetions of the government reconstruction, the construction of the legal system, the improvement of the public participation mechanism and the improvement of citizens＇ consciousness to create a legal guarantee system for promoting multiple cooperative governance.
