直觉思维是一种无意识的加工活动。以审判活动中直觉思维的启动为始,到判决作出为终,直觉会对审判产生一定的影响。对直觉和审判的关系进行研究,运用文献分析、实证分析等方法分析直觉对审判活动产生的影响。直觉固然可以引导审判方向,减少法官的工作量,但过分依赖直觉是危险的,对于这种危险要进行防范。只有重视直觉思维的重要性并予以培养,同时克服对直觉的过分依赖,才能真正使直觉思维步入法治的轨道。

Through the study of the relation- ship between intuition and judgment, using literature analysis, empirical analysis and other methods to analyze the impact of intuition in trial activities. Intuition can lead the way, reducing the judge＇s workload, hut relying too much on intuition is dangerous, we should notice. Only by paying attention to the importance of intuitive thinking and cultivating it, and overco- ming the excessive dependence on intuition, can we truly put our intuitive thinking into the orbit of the rule of law.
