我国反垄断执法机构的局限及优化

On the Limitations and Optimization of China's Anti-monopoly Law Enforcement Agency

我国"双阶层+三机构"的反垄断执法机构模式是根据当时国情制定的,此模式在当下反垄断执法过程中出现了执行力不足、行为管辖冲突和执法尺度不同等问题。通过对国内问题分析并结合现有经验总结,从激励竞争、加强协调与增强监督三方面对我国反垄断执法机构优化提出建议。

The ＂two-tier and three-institution＂ anti-monopoly law enforcement agency model in China was fonnulated in accordance with the national conditions at that time. This model manitested itself in the cun＇ent enforrcement of anti-mo- nopoly law, lack of execution, conflict of behavioral jurisdiction, and ditterent law enforcement standards of the three agen- cieslimitations. Through the analysis of domestic issues and the summarization of experiences at home and abroad, propose suggestions on the optimization of China＇s anti-monopoly law enforcement agencies from the aspects of incentive competi- tion, strengthening coordination and strengthening supervision.
