网上庭审在实践中的运行模式主要为微信庭审模式、类案全流程在线办理平台模式、远程视频庭审模式、微信小程序庭审模式。当前网上庭审仍存在降低消费者质证能力与价值等问题,对消费者的质证权存在不利影响。通过建立专业性与可实现性同时具备的全国统一的网上庭审平台,法官居中搜集证据、划出适合进行网上庭审案件的范围界线,线上证据争议线下鉴定等方式,可降低或消除网上庭审对于消费者质证权的不利影响。

The main modes of the online court trial,in practice,include WeChat mode,the on-line whole process trial,long-distance video trial model,WeChat mini program mode. There are still problems in current system of online trial for example the consumer’s cross examination capacity is reduced. It is suggested to develop a professional and feasible national online trial platform where evidence collection is included the cope of online trial is defined. This can reduce the bad influence on the consumer cross-examination capacity.
