宪法视域下监察权与检察权的衔接

The Linkup Between the Supervisory Power and the Procuratorial Power Under the View of the Constitution

第五次宪法修正,明确了监察委员会的宪法地位,导致了与检察院部分职能与人员的整合,引发了界分监察权属性及监察执法监督与检察法律监督、监察与审查起诉程序及留置与人身强制措施两两衔接的问题。监察权作为具有政治性、监督性、准司法性的公权力,并不会改变检察权的法律监督属性,更不会影响到审查起诉职能的实现,两大权力的整合与分工进一步丰富和完善了我国权力制约体系。

The Fifth Amendment of the constitution clarifies the constitutional status of the supervisory committee,which leads to the integration of the functions and personnel of the procuratorate,which leads to the clarification of the property of supervision,supervision of law enforcement supervision and procuratorial legal supervision,supervision and examination and prosecution procedures,and the connection between each other. As a political,supervisory,and quasi judicial public power,supervisory power will not change the legal supervision property of the procuratorial power,and will not affect the realization of the function of the examination and prosecution.The integration and division of labor of the two powers further enrich and improve the power restriction system of our country.
