摘要
"Uber无人车致人死亡案"这是已知人工智能自动驾驶领域的首次致人死亡事故,但已经不是第一起致人或财产损害的案件,高科技也并非绝对安全,自动驾驶仍存在诸多问题亟待解决。虽然这宗死亡案件让炙手可热的自动驾驶发展呈现降温趋势。但根据现在大数据人工智能的时代背景、行业状况、技术条件、政策扶持以及投资者的热情可以判断自动驾驶乃至最终形态的无人驾驶不会因这起事故而发展停滞。那么这起案件让我们必须思考的就是在未来自动驾驶尤其是无人驾驶技术成熟并应用后,如何对其进行法律规制,保证其行驶在法律的轨道上以致有法可依,以及发生的人身及财产损害时受害人如何进行救济等一系列问题以面对法律滞后性的挑战。
"The death caused by Uber unmanned vehicles" is the first fatal accident in the field of autonomous area,but it is not the first case of human or property damage. High-tech is not absolutely safe. There are still many problems thatneed to be resolved. Although this case of death has brought about a cooling trend to the development of hot automaticdriving. However, according to the current background, industry conditions, technical conditions, policy support, and en-thusiasm of the big data artificial intelligence, it can be judged that autonomous driving and even the final form-unmanneddriving will not be stagnated due to the accident. Well, what we must think about in this case is how to apply autopilot, es-pecially when drone technology is matured and applied, and how to legally stipulate it so as to ensure that it is on the legaltrack so that laws can be followed, and the people involved in the event of property and body damage, a series of problemssuch as how to deal with the relief of the victims to face the challenge of lagging behind the law.
