“网络+”时代传统劳动关系的挑战与应对

摘要 "网络+"时代,"网络+行业"模式的推行使我国传统的经济业态产生了重大变革。经济发展方式、经济结构和劳动用工模式也经历着更为深入的变化,对于现实的劳动法律关系提出了新的挑战,集中反映在:提供服务者与信息平台之间关系难以确定、互联网平台的服务提供者难以实现劳动者权利、劳动权利主管部门态度不明确以及互联网平台与劳动者的劳动法律意识不到位等问题。而这些挑战背后体现的正是现行劳动法律制度在新业态到来之时出现的力有不逮。在深入分析现状及原因的基础上,提出系统性、适应性的解决方案:树立劳动关系领域的社会治理理念、关注劳动法律完善应明确的重点、加强劳动法律的实施保证,并积极响应法治建设的号召,注重相应的人才培养。以期维护劳动者的合法权利、平衡"网络+"时代的新型用工关系,为共享经济的长远建设、法治社会的稳定发展保驾护航。 In the era of "Network plus", the implementation of the "network + industry" mode has made significant revolution in our traditional economic formats. Meanwhile, the mode of economic development, the economic structure and labor employment patterns have also experienced more profound changes, which put forward new challenges to the actual legal relationship of labor. These challenges are reflected chiefly in: 1. The relationship between the service providers and the information platform is difficult to be determined. 2. The service providers of the Internet platform are difficult to realize the rights of workers. 3. The attitude from the competent department of labor rights is ambiguity and the internet platform as well as the laborers' law consciousness is out of place. All those behind these challenges just reflect the paralyzation of the current labor legal systems when the new form of industry arrives. On the basis of in-depth analysis of the current situation and reasons, a systematic and adaptable solution is proposed in this paper such as: establishing the concept of social governance in the field of labor relations, focusing on the perfection of labor legislation, strengthening the implementation and guarantee of labor law and actively responding the call of the legal construction as well as to lay emphasis on the talent cultivation. The schemes above aim at maintaining the legitimate rights of workers and balance the new-type employment relationship in the era of "Network plus" in order to protect the long-term construction of the shared economy and the steady development of the society ruled by law.
