摘要
在房地一体原则的背景下,农村宅基地上所附房屋买卖必然导致宅基地使用权的流转。建国以来,关于农村宅基地使用权的流转的相关政策,大致可以分为三个阶段:"一户一宅"原则的设立、国务院办公厅《关于加强土地转让管理严禁炒卖土地的通知》、宅基地改革试点政策出台。根据现有法律及政策,在非改革试点地区,在集体经济组织成员之间转让宅基地上房屋,在符合买卖合同其他有效要件的前提下,应为有效;向集体经济组织成员以外的农村村民转让宅基地上房屋,在有相关规定的前提下,可以认定为无效;向城镇居民转让宅基地上房屋,原则上应为无效。
Under the background of integration of house and land,the exchange of house site use rightis inevitable for the rural house site of house contract of sale.Since the foundation of the Peoples'Republic ofChina,the relative policies about the rural house site use right can be roughly divided into three stages:therule of one family one house,the General Office of the State Council on Strengthening Management of Transfer of Land and Strictly Banning Speculative Land Dealing and pilot reform policy of house site. According tothe present law and policies,in some non-reform areas and among the collective economics members, thehouse site house transferring is valid if the contract and other constitutive requirements are satisfied.And Thatis invalid if the transferring happens among the non-members and among the citizens of residents in the city.
