铁路旅客黑名单制度探究

Study on the Blacklist System of Railway Passengers

铁路旅客黑名单制度是管控旅客逃票以及危害铁路运输安全等行为的一种重要措施。但在实际操控中,存在着诸多问题:旅客对铁路旅客黑名单制度知晓度不高;铁路旅客黑名单制度适用范围无限扩大;铁路旅客黑名单制定程序缺失、立法不完善;铁路旅客黑名单制度权利救济欠缺。因此,如何完善铁路旅客黑名单制度,使其发挥更好的管控作用,提供更加和谐、安全、可持续发展的铁路运输环境至关重要。本文在总结国内外已有的旅客运输黑名单制度的经验上,结合我国铁路运输的实际情况,提出了合理的完善我国铁路黑名单制度的措施。

Blacklist system of railway passengers is one of the most important measures to control fare evasion behavior of passengers, and endanger the safety of railway transportation. But in the actual operation, many problems appear, such as the passenger awareness is not enough on the blacklist system, the scope of the blacklist system is unlimited expansion, the absence of procedures and incomplete legislation, the rights of railway passenger blacklist system lack of relief. Therefore, it is essential to perfect the blacklist system of railway passengers, and make it play a better role in control and management, as well as provide a more harmonious, safe and sustainable railway transportation environment. On the basis of summarizing the existing blacklist system at home and abroad, this paper puts forward some reasonable measures to improve our railway blacklist system, combining with the actual situation of railway transportation in China.
