海城集体经营性建设用地入市试点调查研究

Investigation on the Pilot City of Haicheng where Collectively-Managed Construction Land has Been Brought to the Market

辽宁省海城市作为试点之一,其在农村集体经营性建设用地入市的主要做法有:按照相关规定及本地区实际情况确定了入市主体、程序及范围,构建了制度框架体系,进行了入市差别化的探索,完善了收益分配方式等。针对目前存在的集体经济组织成员不明确、缺乏城乡统一建设用地基准地价体系、抵押贷款等其他权利难以实现等问题,建议:(1)明确集体经营性建设用地入市主体与客体;(2)探索建立农村集体经营性建设用地价格体系;(3)进一步完善入市收益分配机制;(4)加强农村集体经营性建设用地入市监管。

This paper introduces the main practice that the pilot city of Haicheng of Liaoning province has applied in bringing collectively-managed construction land to the market. These include： identifying the main body, procedures and scope for entering the market in accordance with relevant regulations and the actual situation in the region; building the system of institutional framework; exploring the differentiation of entering the market; developing ways to distribution of income; and etc. As problems that have been encountered during the course of entering the market, they are partly the result of indeterminacy of member of the collective economic organization, the shortcomings of land standard price system of the integrated construction land market between urban and suburban regions, as well as other rights liking mortgages have been unrealized. In light of this, this paper offers some specifc methods for improving this situation. These methods lay emphasis on the following： clearly defning the subject and object in bringing collectively-managed construction land to the market; exploring ways to establish a price system for rural collectively-managed construction land; further improving the income distribution mechanism for entering the market; enhancing efforts to monitor the rural collective management of construction land into the market.
