摘要
在现有的法律关系框架下,如何采用新型的"契约-参与型"学生管理模式来解决高职院校学生管理过程中遇到的问题显得尤为重要。该模式注重把握社会行为和个体行为在法律上的交叉点,以"契约"的方式明确高校和学生之间的权责关系,把管理事务分解到部门和个人。高校可以从契约法律关系的主体、程序机制、实体内容、责任体系以及救济途径等方面构建高校与学生的契约化法律关系。
Under the existing legal relationship framework, how to adopt the new “contract-participation” studentmanagement mode to solve the problems encountered in the process of student management in higher vocational collegesis particularly important. This model focuses on grasping the legal intersection between social behavior and individualbehavior, and clarifying the relationship of power and responsibility between universities and students in a“contact” manner, and decomposing management affairs into dep时ments and individuals. Colleges and universitiescan construct the contractual legal relationship between colleges and students from the aspects of the subject, proceduremechanism, entity content, responsibility system and relief channels of the contractual legal relationship.
