仲裁法对缺席仲裁无详细的规定,导致实践中对缺席仲裁的把握标准不一。本文从仲裁的实践出发,就缺席仲裁的裁决原则、仲裁庭主动审查的范围、案件审查的深度三个方面进行研究,归纳缺席仲裁案件审理的基本做法或原则。在前述基础上,提出缺席案件风险控制的措施,以便提升缺席案件审理的质量,降低裁决风险。

No clear rules in the Arbitration Law regulate the proceedings of default arbitration.This situation thus entails various forms of practice.The article examines the principles of decision-making and the scope and depth of the tribunal’s voluntary review so as to conclude the basic principles for default arbitration from a practical perspective.The article suggests some measures for risk control of the default cases,which will help to heighten case management of those cases.
