我国网络规制的组织构造及其优化路径

网络规制的模式选择和组织构造间存在互构关系,回应型网络规制要求规制组织形态的虚拟化、机制的弹性化和结构的扁平化。随着网络社会不断发展,我国逐渐形成基于代理式监管与运动式整治的双重网络规制模式。在转向回应型规制的过程中,必须超越组织困境。虽然我国网络监管体制不断调适,但总体是"条块分割"体制在网络空间的延伸,形成组织分离但功能一体的组织构造。它具有一定的创新性,也有很多局限性,应在宏观、中观和微观层面进行优化。

There is an interaction between organizational structure and strategic choice in China＇s network regulation.Responsive network regulation requires that the organization be virtual,the mechanism be flexible,and the structure be flat.With the continuous development of network technology,China＇s network regulation has the dual logic of a proxy regulation and concentrated regulation.In the turning to responsive regulation,structural dilemma must be surpassed.While the regulation system adjusts to the continuous change,it still remains an extension of the＂bar segmentation＂in the network space,separated in organization yet integral in function.Notwithstanding the novelty in such regulation,the limitations within it call for the optimization on the macro,medium,and micro level.
