Exemption and Relief of Information Disclosure of Professional Title Evaluation in Public Universities

公立高校职称评审中的信息应予公开抑或豁免公开,这是法益权衡的结果,公开保护的法益主要是评审的公平公正,而豁免公开保护的法益主要是自治权与隐私权。涉及评委隐私的信息以及高校自治范畴内的过程性信息可予豁免公开。因高校职称评审中信息公开与否而产生的争议,可以通过举报、申诉、复议以及诉讼等途径获得救济,但目前这些救济途径的实效性还有待加强。

Public universities shall make the information public or exemption from public in the title appraisal,which is a result of legal interest balance. The former is mainly to protect the legal interests of the fairness and justice,and the latter is mainly to protect the legal interests of autonomy and privacy right. Information involving the judges＇ privacy and process information of universities can be exempt. The dispute arising from whether the information should be open to the public in the title appraisal can be solved by reporting,appealing,reconsidering and litigating,but the effectiveness of relief has remained to be strengthened currently.
