The Nature and Control Range of Exclusive Publishing Right

在教育科学出版社诉长江文艺出版社侵害专有出版权案的审理过程中,北京知识产权法院终审判决长江文艺出版社并不侵害教育科学出版社的专有出版权。终审判决的作出基于两个要点:一、专有出版权不属于著作邻接权,而是指在特定领域即图书出版发行行业内著作权中的复制权和发行权这两个权项。二、专有出版权指向的客体应为图书的整体或实质性部分,而不能延及图书中各个非实质性的组成部分。如何根据案件事实,综合运用文义解释、体系解释、目的解释、利益考量等法律解释方法,作出经得起生态圈评判和时间考验的判决,是一个值得思考的问题。

During the trial of the case of infringement of publishing right by Education Science Press and Changji-ang Literature Art Press,Beijing Intellectual Property Court decided that Changjiang Literature Art Press didnot infringe on the exclusive publishing right of the Educational Science Press. The final judgment is based on twomain points：first,exclusive publishing right is not the neighbouring rights of copyrights;it only refers to the tworights of copyright：reproduction right and distribution right. Second,the object of exclusive publishing rightshould be the whole or substantial part of the book,and can not be extended to the non-essential parts of the book.According to the facts of the case,it is a question worthy of consideration to make comprehensive use of legal inter-pretation methods,such as the interpretation of literal meaning,system interpretation,purpose interpretation,andthe consideration of interest,so as to stand up to the judgment of the ecological circle and the test of time.
