摘要
产教融合中的教育界与产业界的关系就是合同关系。这种双方合同关系,首先考虑合同本身的特点和外在的特点,本身的特点就是合同双方的协商关系,外在的特点就是合同的合法关系。合同双方的协商关系,具体就是双方合同利益的平衡问题。这个合同利益的平衡,是由合同双方的社会角色社会分工决定的,因而这个合同利益的平衡需要政府相关部门的协调和支持。产教融合的具体模式,仍然需要不停探讨和完善。
The relationship between educational institutions and enterprises in industry-education fusion is based on the contract.What should be firstly considered are the internal and external features of the contract,when this kind of relationship is to be established.Its internal features lie in the negotiation relationship between the two parties of the contract,and its external features in the legal relationship of the contract.The former relationship is specifically about the interest balance of the both parties,which depends on their social roles and division of labor.To reach such a balance,the coordination and support from the relevant government sections is required.Continuous researches should be done to build a definite pattern for the fusion.
