大数据时代个人数据权的特征、基本属性与内容探析

Analysis of the Characteristics,Basic Attributes and Contents of Personal Data Right in the Era of Big Data

[目的/意义]大数据时代公民个人数据权的保护与利用成为各国立法关注的主要内容。[方法/过程]运用文献分析法、比较法,对中外现行法律法规中个人数据权的法定概念、特征、基本属性及其权利内容进行了对比分析。[结果/结论]目前各国现行个人数据保护法主要针对其人格权进行保护,个人数据控制权处于不断加强中,个人数据财产权保护将是未来研究重点。目前对个人数据财产权的立法保护主要是禁止他人非法交易,值得深入探讨。

[ Purpose/significance] The protection and utilization of personal data right of citizens in the era of big data has be- come the main content of the legislation of all countries in the world. [ Method/process ] By using the method of literature review and comparison, this paper makes a contrastive analysis of the statutory concepts, the characteristics, basic attributes and right con- tent of personal data right in the current laws and regulations of China and foreign countries. [ Resuh/conclusion ] The current per- sonal data protection laws primarily protect the personality rights in various states. The personal data control right is enhanced con- stantly, and the protection of the property right of personal data is about to be the emphasis in future research. At present, banning the illegal transaction is the main purpose in legislative protection of the property right of personal data, which deserves further dis- cussion.
