摘要
[目的/意义]为了科学处理在线开放课程建设与运营中主体、平台、学习者、教学资源等之间的著作权归属、许可使用等问题,在在线开放课程著作权垄断利益保护和知识共享社会利益保护两者之间寻求新平衡。[方法/过程]文章从在线开放课程建设与运营的利益相关者分析入手,在分析了利益相关者构成及不同利益相关者面临的著作权问题的基础上,具体讨论在线开放课程著作权流转的策略。[结果/结论]提出了包括科学处理在线开放课程著作权流转中的不同主体关系、识别在线开放课程著作权流转的关键问题以及建立在线开放课程著作权集体许可和公共许可的管理机制等建议。
[ Purpose/significance] This paper aims to handle the issues of copyright ownership, licensing, and so on among the participants, platform, learners and teaching resources of open online courses, and to seek balance between the interests protec- tion of copyright monopoly and social benefit protection of knowledge sharing. [ Method/process ] This paper analyzes different stakeholders of the open online courses construction and operation. Based on the constitution of stakeholders and copyright issues faced by different stakeholders, the paper specifically discusses the copyright transfer strategies of open online courses. [ Result/ conclusionJ Key strategies are proposed including scientific treatment of relationships among different stakeholders in the copyright transferring of open online courses, identification of the key issues in copyright transferring and establishment of the management mechanisms in copyright collective licensing and public licensing for open online courses.
