“Fengqiao Experience” and the Rural Social Management Combining the Rule of Law with Rule of Virtue in the New Era

探索新时代中国乡村治理之路,必须在历史、现实、未来的三维度中,将"枫桥经验"置于"依法治国与以德治国相结合"的战略中加以深入研究,必须从中国的历史与国情出发,认识坚持德法并举治理乡村的必然性。现实中"枫桥经验"的"矛盾不上交""平安不出事""服务不缺位"三大内容,是贯彻德法并举方针的硕果。未来的乡村治理必须将德法并举作为当代中国乡村"三治结合"治理的基础,正确处理准绳与基石、情理和法理、感召与威慑的关系。

In order to explore the rural social management in China in the new era, the “Fengqiao Experience” must be applied to the strategy of “combining the rule of law with the rule of virtue” in the three dimensions of the past, the present and the future. It is crucial to understand the inevitability of adhering to this strategy, taking into account the Chinese history and national conditions. “Not handing social conflicts to high-level authorities”, “ensuring safety” and “providing satisfactory social services” are the fruits of promoting the policy of combining morality with law enforcement. The future rural social management must take the combination of the rule of law and the rule of virtue as the foundation and correctly handle the relationships among the criterion and the cornerstone, sense-making and jurisprudence, and inspiration and deterrence.
