监察权作为独立的权力类型,其证据规则构建的前提在于对监察权进行学理解析,以期通过明晰其权力运行范式,有针对性地构建系统的监察证据规则。具体范式为厘清权力的性质以付之予价值理念、权力的层次以付之于规则的衔接流转、权力的对象以付之其证明标准的区分应对。而置于监察语境下证据规则的司法构建则应从两个维度展开,其一是应然功能维度,从证据规则所应然具有的功能反向确立具体证据规则的逻辑体系,即将保障基本人权、规范证据运用、查清犯罪事实为其应然的功能预设。从而依次构建证明标准、调查取证制度、特殊证据制度。其二,则是立足于实然运作层面,构建监察程序与司法程序衔接中的证据转化制度,以形成完整的规则逻辑体系。

Supervisory authority,as an independent type of power,presupposes that the rules of evidence construction are based on the understanding of the state supervisory authority.And by clarifying its power operation patterns,systematic evidence rules of supervision are able to form.Specifically reflected by Defining the nature of supervisory authority to assign correspondent values,and clearing its context to form the connection and conversion of rules,and the proof standards can be comprised by clarifying implementary objects of such power.The judicial construction of evidence rules placed in the context of supervision should proceed from two dimensions.One is ideal function.The logical system of concrete evidence rules is confirmed by ideal function of evidence rules,including protecting basic human rights,using evidence appropriately and finding out the crime.So the proof standards,investigation institution and evidence collection system,special evidence system are likely to be constructed.Secondly,in order to form a complete system of rules,the state must build a system of evidence conversion in the convergence of monitoring procedures and judicial procedures,based on the level of actual operations.
