On the View of Social Contract from Utopia to Law: a kind of Basis of Evidence of Institutional Rhetoric

社会契约理论起初不过是人们假设的一种乌托邦。社会契约理论从乌托邦到现实政治的过程,乃是一个法律化的过程。法律就是社会契约的一般规范表达。法律本身承载的"作为乌托邦的社会契约"使命,使得法律自然具有制度修辞的属性。

The social contract theory is originally no more than an utopia that people assumed.The process from an utopia to the nature of realistic politic of the social contract is a process of legalization.Laws is a way of a general expression of rules of the so- cial contract.Laws themselves endure the mission of the social contract as an utopia, which makes laws have properties of institu- tional rhetoric naturally.
