大数据与人工智能司法应用虽与传统司法信息化有着承继关系,但却呈现出技术介入的广泛性与深刻性。前沿技术地位的提升在司法场域中引发了"一种实践、两套话语"的独特现象。此种"话语分裂"是法学专业知识与科学技术知识塑造的专业权力与技术权力在司法场域中外化为专业话语与技术话语进而形成冲突。在下一阶段大数据与人工智能司法应用的过程中要协调话语冲突,推动技术知识与专业知识的深度融合、明晰技术权力对专业权力的介入边界。

The applications of judicial big data and artificial intelligence are strongly connected with the traditional judicial infor-matization, however they also have been embedded with apparent unique characteristics, especially in the depth and range of thecutting edge technologies＇ influence on judicial system. With the rise of technologies, different entities regarding judicial systemare expressing distinguished discourses on the cutting-edge sciences and techniques. The foresaid phenomenon is because that inthe field of judicial system, legal knowledge and technological knowledge produces conflicts between the legal power and techno-logical power. And the power-conflicts externalize as conflicts between the legal discourse and technological discourse. To recon-cile the discourse conflict, we must push forward the fusion between legal knowledge and technological knowledge, and set a defi-nite boundary for the technological power which gets involved in legal power.
