少数民族就业权法治保护现状及其完善建议

The Legal Protection Situation and Improvement Recommendations of Employment Rights of the Ethnic Minorities

我国法律或政策规定了少数民族就业享有平等权和多方面的照顾优待,但是这些规定比较分散,强制力不够,导致各地理解不同、执行状况不一。为了切实保障少数民族就业水平和质量能够有一个较大的提升并在尽可能短的时间内在整体上消除与主体民族就业方面的差距,建议从中央层面完善《就业促进法》相关条文,着手制定《少数民族权益保障法》和《少数民族就业权保障条例》,规定平等就业、优先照顾、特设岗位、比例就业、扶助服务等少数民族就业权保障内容;同时规定全国范围内的公共部门的主体责任,和私营部门落实相关政策享受的政策措施;并建立完善全国人大主导国家民委主责的少数民族就业发展年度报告制度、劳动执法部门主责的执法监督和司法系统的诉讼制度,以督促相关少数民族就业法律法规和政策的切实实施。

The law and policy of China have formulated ethnic minorities to enjoy equal rights and multifaceted cares in employment,but these provisions are scattered,with insufficient forcement,resulting in different interpretations and different status of implementation.In order to effectively have a larger increase in the ethnic minority employment levels and quality in the shortest possible time to eliminate the gap between the main ethnic,advice for the national level to improve the relevant provisions concludes amending ＂Employment Promotion Law＂,creating ＂Minority rights Protection law＂ and ＂Minority Employment Right Protection Ordinance＂,to strengthen or establish ethnic minority rights of equal employment,preferential treatment ad hoc jobs,affirmative plan,support services and etc.;to strengthen the main responsibility of the public sector nationwide,and definitude preferential policies for the private sector;and to establish and perfect report system of the employment development of ethnic minorities,the enforcement systems of inspecetion of labor administration and judicial inquiry,in order to supervise the effective implementation of the relevant laws,regulations and minority employment policies.
