机会丧失理论在医疗损害诉讼中的应用探讨

Discussion on the Application of Loss of Chance Theory in Medical Damage Litigation

随着《侵权责任法》及最高人民法院《关于审理医疗损害责任纠纷案件适用法律若干问题的解释》的颁布与实施,涉及医疗损害诉讼的司法鉴定案件继续呈现逐步上升的趋势,同时机会丧失的判决案例在我国也愈发多见,但迄今仍未形成统一的分析判断标准与操作原则。通过介绍机会丧失学说的起源、国内外实际应用以及近年来理论与实践的发展等内容,对机会丧失理论做一综述,为司法鉴定领域引入机会丧失学说提供理论基础,为医疗损害诉讼案件的处理提供参考与借鉴。

With the enactment and implementation of the Tort Liability Law and the Interpretation of the Supreme People＇s Court on Several Issues Concerning the Application of Law in the Trial of Medical Damage Liability Disputes, judicial appraisal cases involving medical damage litigation are showing a gradual upward trend. At the same time, the judgments on cases of loss of chance are more and more common in China, but so far there haven’t been unified standards. This paper introduces the origin of loss the chance, the application and development at home and abroad, and makes a retrospective summary of the theory of loss of chance. It provides a theoretical basis for introducing the theory of loss of chance in the field of forensic expertise, and provides a reference for the treatment of medical damage litigation cases.
