摘要
教育目的具有双重性,其植根于文化土壤,并体现在教育法之中。这种双重性影响了教育法的基本内容。首先影响了教育法律的基本主体:学校和教师。教育目的的个体性决定了学校不完全是公法上的主体,教育目的的公共性决定了学校不完全是私法上的主体。学校法律身份的双重性也导致了教师身份的尴尬,教师既非公务员也非劳动者。同时,教育目的的双重性决定了受教育具有权利和义务的双重属性,义务教育阶段,教育目的的公共性更强,受教育就更倾向于是义务;民办教育中,特别是民办职业教育中,教育目的的个体性更强,受教育就更倾向于是权利。
The purpose of education is twofold.It is rooted in culture and reflected in education law.This duality affects the basic content of the education law.First,it affected the basic subjects of education law:schools and teachers.The individual purpose of education determines that the school is not completely the subject of private law,and the public nature of the educational goal determines that the school is not exactly the subject of public law.The dual nature of the school' s legal status also led to the paralysis of teachers' status.Teachers are neither civil servants nor laborers.At the same time,the dual purpose of education determines that education has the dual attributes of rights and obligations.At the stage of compulsory education,the public purpose of education is stronger,and education is more likely to be an obligation.In private education,especially in private vocational education,the purpose of education is more individual and education tends to be more of a right.
