平衡视阈下的警察执法权威研究

Police Authority of Law Enforcement from the Perspective of Equilibrium

平衡理论体现了法哲学研究范式从权利本位到权利义务平衡本位的新发展,既是价值观,也是方法论,又是认识论。用平衡理论分析警察权威弱化的原因,得出的结论为:我国警察权威弱化是由于警察执法与警察权益保障失衡;警察职能与警察工作效能失衡;社会阶层固化与利益分配失衡。在平衡理论的指导下重振警察权威,应当从以下几方面考虑:以权利义务平衡原理构建警察法律体系,使警察执法有法可依;平衡好警察使用武力的权力与保护公民权利的关系;平衡警察执法权限,确保警察执法效能。

The theory of equilibrium represents the new progress in research methods of philosophy of law from right-oriented to an orientation on the balance of rights and duties. The theory of equilibrium is a value, a methodology and also epistemology. This thesis analyzed the reasons for an undermined police authority with equilibrium theory and concludes that it is attributed to imbalances between law enforcement and guarantee of police rights, between duties and efficiencies of police and between social hierarchical solidification and interest distribution. It is suggested to rally police authority with the guidance of equilibrium theory and reconstruct police law system. And a balance should be stroke between police＇s use of force and protection of civil rights so that police efficiency of law enforcement can be guaranteed.
