职务犯罪治理的失衡表现及平衡法应对

Imbalance in Prevention of Duty Crimes and Equity-Based Countermeasures

随着社会经济发展,职务犯罪不断出现新的历史特征,仅依靠刑事手段不能从根本上遏制犯罪发生,需从根本上铲除其赖以存在的土壤。但在当前对职务犯罪的治理过程中,出现诸多失衡的表现,导致治理成效甚微。随着治国理政观念的变迁,我国所采取的犯罪对策观已经发生转变,基于此,在平衡法的视域下对职务犯罪、职务犯罪的失衡表现进行分析和研究,提出相应的平衡措施,试图为职务犯罪治理提供一种新的治理思路。

Along with social-economic progress, duty crimes are constantly demonstrating new characteristics. They cannot be prevented solely by crime investigation. It is imperative to fundamentally rid off the soil from which they grow. Low efficiency in containing this is attributed to imbalances in prevention. Along with evolution of idea country governance, there have been shifts in the idea of countermeasures of crimes. The thesis analyzes the patterns of imbalance of duty crimes from the perspectives of equity. And countermeasures are put forward in expectation of new ideas for prevention.
