法律解释主体间配合关系的反思与重构

Reflection and Rebuilding of the Cooperative Relationship between the Subjects of Legal Interpretation

法律具体应用解释主体在法律解释的制定以及实施过程中形成各种配合关系,对于法律解释、法律解释体制乃至宪法秩序有显著影响。实践中,法律解释制定中的配合关系主要表现为联合解释和法律解释过程的参与,法律解释实施中的配合关系表现为法律解释的认可。我国法律解释主体间配合关系的丰富,源于全国人大常委会怠于行使职权,法律解释主体权力的扩张为配合关系的丰富创造条件,配合关系的形成则取决于法律解释主体的主观动机。面对配合关系之弊,应确立关系的规制方案和配合之弊根除的方案。

The subjects of legal interpretation form a variety of cooperative relationships in the process of interpreting and imple- menting laws, which have a significant impact on the legal interpretation, legal interpretation system and even the constitutional order. In practice, the cooperative relationship in the process of interpretation is mainly manifested by the joint interpretation and the participation of legal interpretation process, and the cooperative relationship in the implementation of legal interpretation is done by the approval of legal interpretation. Why the cooperative relationships are so rich？ Firstly, the NPC standing committee is idle to exercise its authority. Secondly, the the subjects of legal interpretation expand their power and have motives. In the face of the disadvantages of cooperating relationship, we should establish the schemes of regulation of the relations and of elimi- nation of the ill cooperation.
