天津市2011—2016年卫生行政处罚案卷情况分析

目的总结天津市2011—2016年案卷评查工作,分析并归纳卫生行政处罚案卷制作过程中存在的重大、典型问题,以问题为导向,进一步做好卫生计生监督稽查工作,规范卫生计生行政执法行为。方法整理汇总2011—2016年天津市案卷评查工作中544份处罚案卷(不含餐饮专业)的评查结果,运用Excel 2007进行分析。结果案卷质量整体呈上升趋势,控烟专业与生活饮用水专业案卷质量普遍较高,职业与放射卫生专业案卷质量普遍较低;评查中发现重大问题(一票否决)共计75个,其中被处罚对象认定错误、违反法定程序、法律适用错误分别占所有重大问题的32%、24%、17.33%;整体上看,544份处罚案卷出现一般性问题共1 161次,其中重复出现10次以上的典型问题共计26种。主体方面出现一般性问题59次,包括3种典型问题;事实与证据方面出现一般性问题313次,包括5种典型问题;程序与文书方面出现一般性问题495次,包括10种典型问题;法律适用方面出现一般性问题152次,包括5种典型问题;案卷归档方面出现一般性问题142次,包括4种典型问题。结论充分认识案卷评查工作的重要性,强化案卷评查中应建立制度化、规范化,同时注重评查结果运用。

Objective The purpose of the paper is to summarize the evaluation work of penalty cases in Tianjin from 2011 to 2016, to analyze and conclude the major and typical problems in the process of health administrative punishment, which is problem-oriented so as to further improve the inspection work in health and family planning, and to regularize law enforcement behaviors. Method The paper collects evaluation results of 544 penalty cases （not including the catering pro- fession） and uses Excel 2007 to make an analysis. Results The quality of the penalty cases shows an increasing upward trend, among which the quality of cases in smoking-control and drinking water professions are relatively higher, while that of occupational and radiation health profession are quite lower. The total number of major problems found in the evaluation （veto） is 75, among which the problems in faulty allegation of object to be punished, violation of legal procedure as well as faulty legal application respectively account for 32%, 24%, 17.33%. On the whole, there are 1 161 pieces of general prob- lems in all penalty cases, in which the typical problems that appear more than 10 times sum to 26 types. Specifically, the general problems in the aspect of main subject appear 59 times, including 3 kinds of typical problems; the ones in evidence and facts are 313 including 5 kinds of typical problems; the ones in procedures and documents appear 495 times, including 10 kinds of typical problems; the ones in the application of the law are 152, including 5 typical problems; and the general problems in cases archive appear 142 times, including 4 kinds of typical problems. Conclusion It is suggested to fully understand the importance of inspection on penalty cases, strengthen the institutionalization and standardization of evaluation system of penalty cases, and focus on the application of evaluation results.
