中国船舶油污损害赔偿基金制度的不足与完善

Deficiencies in the Chinese Ship-sourced Oil Pollution Compensation Fund regime and the improvement thereof

分析中国船舶油污损害赔偿基金制度在法源位阶、赔偿范围、赔付实践,以及对理赔异议的救济方面存在的不足,提出完善基金制度的意见和建议,包括提高基金法源的位阶、扩大基金赔偿范围、赔付项目标准化、确定比例赔偿、设立应急专项分基金,以及规定索赔发生异议时对油污受害人的救济途径,充分发挥基金在海洋环境保护与海洋强国战略建设中应有的保障作用。

This paper analyses the deficiencies in the Chinese Ship-sourced Oil Pollution Compensation Fund regime with respect to the level of the sources of law,the scope and practice of compensation,and the relief available for objection to the result of compensation. Suggestions on the improvement of the regime are put forward including raising the level of the sources of law,expanding the scope of compensation,standardizing the compensation items,adopting the principle of compensation in proportion,setting up an emergency fund and providing relief available for objection to the result of compensation to ensure the function of the fund in marine environment protection and the development of maritime power strategy.
