改革开放40年我国民法的发展与展望

On the Development and Prospect of China's Civil Law with 40 Years of Reform and Opening-up

民法在法律体系中处于基本法的地位。自改革开放以来,我国的民法实现了从无到有的跨越,并已经成为保障市场经济体制建设和人民权利的重要法律。但是由于受到了历史的局限,现行民法仍存在一定的不足,面临一定的挑战。只有出台民法典,我国民法才能真正得到完善和发展。

The civil law is in a basic law position in the legal system. Since the reform and opening-up,China＇s Civil Law has achieved a leap from nothing to something, and it has become an important law to ensure theconstruction of the market economic system and protect the rights of the people. However, there are still certaindeficiencies in the current Civil Law due to the historical limitations, which faces challenges. Only by enacting thecivil code can China＇s Civil Law be perfected and developed truly.
