摘要 当代中国法学教育突出地强调了"实践教学",但却并未领会"实践"的真谛,与理论的游离更使"实践教学"日益显示其片面性。理论训练的缺失使得法学教育显得幼稚且浅薄,沉浸在部门法的知识化学习当中却遗忘了背后的理论元素。缺乏理论训练的法学教育无法培养学生强大的思想世界,更难以有效提升法律实践的层次和水平。这就要求法学教师必须首先训练自身的理论素养,同时加大课程设置中理论课的比重,理论训练应该体现在每一门法学课程当中。法学理论教育内在地蕴含着一种精神教育,精神的嵌入将在最高层面上提升法学教育的质量,这也是中国法治建设所必需的。 Contemporary Chinese law education emphasizes "practical teaching", but failed to grasp the true meaning of "practice".With the dissociation of theory, "practical teaching" increasingly shows its one-sidedness and the lack of theoretical training makeslegal education naive and limited. Being hnmersed in the knowledge-based learning of departmental law, "practical teaching" hasneglected the theoretical elements behind it. Legal education without theoretical training cannot cultivate students' strong ideologicalworld, and it is more difficult to effectively raise the level of legal practice. This requires legal teachers to firstly train their owntheoretical literacy, and increase the proportion of the theoretical coursesin the curriculum, with theoretical training reflected in everylaw course. Legal theory education inherently contains a kind of spiritual education. The embedding of the spirit will enhance thequality of legal education at the highest level, which is also necessary for the construction of the rule of law in China.
