摘要
英国通过全民公投做出了脱离欧盟的决定,根据英国法律,议会有权力决定任何公投的结果是否有效,对于此次公投结果议会并未出面干预。很显然在是否"脱欧"这个问题上全民公投发挥了决定性作用,但这并不意味着直接民主替代了间接民主,代议制仍然是民族国家最主要的民主形式,这是由代议制理性、高效的特点决定的。因此,允许全民公决发挥作用并不意味着代议制退出历史舞台,这意味着现代民主制度正向着多元化的方向发展,二者能够更好的协同发挥作用,使得决策既符合民意,又理性可循。
The British made a decision to leave the European Union through a referendum. According to the British law, the parliament has the power to determine whether any referendum results are valid. The parliament did not intervene in the results of this referendum. It is clear that the referendum has played a decisive role on this issue. However, this does not mean that direct democracy has replaced indirect democracy. Representative government is still the most important form of democracy in all countries. This is determined by the merits of representative rationality and high efficiency. Therefore, allowing the referendum to play a role does not mean that the representative system is withdrawn from the historical stage. This means that the form of the modern democratic system is moving towards a diversified direction. The two can work together better to make the decision not only in line with public opinion but alsorational.
