Challenges, Opportunities and Tasks for the Legal Construction of Medical Insurance in the New Era

全面建立中国特色医疗保障制度是我国的一项重大决策。在中国特色社会主义进入新时代的大背景下,通过系统回顾总结我国医保制度改革和医保法治建设成就、经验和问题,迎接新时代医保法治建设的挑战,抓住国家高度重视社会建设的机遇,理顺医保管理的体制机制,通过国际国内医保立法经验丰富医保法治建设,为更好完成新时代医保立法三方面的任务(为医疗保险和生育保险合并实施提供法律依据、制定基本医疗保险条例以及根据改革需要做好配套法律法规的立改废释等工作)提供有效借鉴。

Building universal medical insurance system with Chinese characteristic is one of the major policy decisions in China. In the new era, a thorough review of the history of medical security reform and legislation will help us grasp the new opportunity facing medical security legislation. There are three major opportunities attaching great importance on society building by the government, optimizing the system and mechanism of medical security management and the local-and-international experiences and lessons of medical security reforms especially medical insurance. In order to grasp the opportunities and complete the medical security legislation tasks, we should ？ rstly make delegated legislation on combined implementation of medical insurance and maternity insurance, and then make new regulations on basic medical insurance and make other amendments or interpretations on relevant and regulations.
