摘要 国际私法教学改革是近些年来国际私法学界面临的重要课题之一。鉴于法律选择理论和方法的多元性以及价值取向的多维性,在国际私法教学中有必要引入多维思维方法。这不仅能够使学生更好地理解各种法律选择理论和方法之间的关系,而且有助于提高学生的实践操作能力。国际私法多维思维能力的培养要求学生在法律选择的观念上由"立法中心主义"向"司法中心主义"转变,充分认识到准据法的确定是一个多维思维的结果,法律选择过程既是"找法"的过程,同时也是"法律选择正当化"的过程,而法律选择正当化应当从形式、实质和程序三个向度上展开。 The teaching reform of private international law is one of the important topics faced by the private international law community in recent years. In view of the muti-dimensionality of legal choice theory and method and plurality of value orientation, this paper proposes that it is necessary to introduce muti-dimensional thinking method in the teaching of private international law, which can not only enable students to better understand the relationship between various legal choice theories and methods, but also help them to improve their practical skills. The cultiva- tion of muti-dimensional thinking ability in private international law requires that students change from "legislative centralism" to "judicial centralism" in the concept of legal choice, fully realize that the determination of the applicable law is the result of a muti-dimensional thinking, the process of legal choice is not only the process of "seeking law", but also the process of "justifying legal choice", and the legitimacy of legal choice should be carried out from the three aspects of form, substance "and procedure.
