随着我国教育事业的不断发展,教育培训合同在日常社会生活中愈发普遍。由于我国《合同法》的立法模式并未将教育培训合同视为有名合同,未能释明教育培训合同的法律适用问题,尤其是教育培训合同中的服务瑕疵问题更是无据可依,而学者关于教育服务合同中教育服务瑕疵问题的研究也并不多见。因此,有必要对教育培训合同中服务瑕疵问题予以研究,以便更好地解决因教育培训合同引发的纠纷。

With the continuous development of education in our country, education and training contracts have become increasingly common in daily social life. Because the legislative model of China＇ s ＂Contract Law＂ does not regard education and training contracts as well - known contracts, it has failed to clarify the legal application of education and training contracts, especially the problem of service defects in education and training contracts. Scholars＇ research on the issue of educational services in educational service contracts is also rare. Therefore, it is necessary to study the problem of service defects in education and training contracts in order to better resolve disputes arising from education and training contracts.
