论担保性房屋买卖合同的效力——以最高院案例引入为视角 被引量:1

摘要 民间借贷中,当事人常以签订房屋买卖合同作为借贷合同的担保。对于这种新型的担保形式,最高院为应对司法实践中的难题,出台了相关的司法解释。在该司法解释中,规定人民法院按照民间借贷的法律关系进行审理。对于这种新型的融资手段,分析其是否属于合同法上的通谋虚伪表示,是否违反了物权法定的原则和禁止流质契约的强制性规定,提出应该尊重当事人的意思自治,将这种担保形式纳入法律调整的范围更有利于对于社会经济秩序的管理。 In private lending, people often sign a house sale contract as a guarantee for a loan contract. For this new form of guarantee, the Supreme Court has issued relevant judicial interpretations in response to the difficulties in judicial practice. In this judicial interpretation, the people's courts are required to conduct trims in accordance with the legal relationship of private lending. For this new type of financing, we should analyze whether it belongs to the hypocrisy of conspiracy in the contract law, whether it violates the principle of legal property and the mandatory provisions prohibiting liquidity contract, and proposes that the party's meaning autonomy should be respected. Incorporating the scope of legal adjustment is more conducive to the management of social and economic order.
