撤销未成年人监护权的条件及其后续保障研究

对未成年人的合理监护是保护未成年人利益的重中之重,而现实生活中家庭是未成年人权益侵害的来源之一。家庭传统观念较深的中国在未成年人受到监护人的侵害时应当严格适用撤销条件,以积极侵害与怠于履职为依据,并考虑其严重程度是否达到了撤销的标准。撤销监护权是权益保护的手段,利益保障才是撤销的目的。因此,在撤销制度的背后应该维护好临时监护制度、监护权恢复制度,做好未成年人的后续安置工作。

In China, with a deeper family tradition, we should strictly apply the conditions ofrevocation when the minors are infringed by the guardians, and consider whether their severity hasreached the standard of revocation, with active infringement and neglect of performance as basis.Moreover, the revocation of guardianship is a means of protecting the rights and interests ofminors. Therefore, the system of temporary guardianship and guardianship restoration systemshould be maintained behind the revocation system, and the subsequent arrangement of minorsshould be done well.
