摘要
盐城市农业科学院司法鉴定所审核了委托人(T市公安局)提交的鉴定材料之后,指派司法鉴定人对涉案水稻田进行现场勘验和调查取样,鉴定结果表明:涉案水稻的穗颈瘟发病率明显高于对照田块,其中水稻的结实率和千粒质量2项指标低于正常标准,是造成涉案水稻减产的直接原因。结实率和千粒质量指标偏低与穗颈瘟严重发生密切相关,穗颈瘟严重发生与水稻田使用涉案农药"三环唑"具有因果关系。通过审核鉴定材料和对鉴定结果的分析判断,鉴定组确认涉案农药是假药,使用假农药"三环唑"与涉案水稻减产具有因果关系,同时估算了涉案水稻减产的经济损失,出具的司法鉴定意见书被法院判决时完全采信。
After reviewing the appraisal materials submitted by the client(Public Security Bureau in T City), we assigned judicial appraisers to conduct on-site inspection and investigation and sampling of the rice fields involved. The results showed that the investigated fields had a significantly higher incidence rate of neck blast on rice than the control field, as well as a lower seed setting rate and 1 000-grain weight of rice than the normal standard, which were the direct cause of the reduction in rice production there. The reductions in seed setting rate and 1 000-grain weight index were closely related to the severe occurrence of rice neck blast in the involved fields. The severe occurrence of neck blast had a causal relationship with the application of the so-called pesticide "tricyclazole" in the involved rice fields. Through the identification of the so-called pesticide "tricyclazole" applied and field investigation, the identification team found that the pesticide involved in the case was a fake drug, and the application of the fake pesticide "tricyclazole" had a causal relationship with the reduction in rice production in the involved fields. The identification team also estimated the economic loss of the rice reduction in the case, and issued the judicial appraisal opinion, which was then completely accepted by the court when the case was judged.
