网络公共领域是一个新的公共领域,也是一个新的常态体,它的存在、壮大意味着在国家治理体系中政府治理的空间结构发生了显著变化。当我们面临网络舆论及其所形成的新公共领域的治理问题时,我们必须从超越哈贝马斯基本观点的高度出发,重新确立和维护基于网络公共领域的"国家——网络"治理、"公共行政——网络领域"关系,在法治理念下建构网络公共领域与政府治理互为依托的新秩序。
