改革开放40年中国刑法学研究的成就与展望

Achievements and Prospects of China’s Criminal Law Research over the Past Forty-year Reform and Opening up

1978年以来,随着我国改革开放的逐步开展与深入,刑事法治进程迅猛发展。40年来,刑法典的颁行及修正、刑事司法实践与刑法学研究互动频繁、相互促进,域外刑法理论的涌入为我国刑法学研究增添新的研究路径,拓宽新的研究领域。刑法学研究已完成理论体系建构、基础研究深化、新兴领域探索、研究方法多元的历史使命。学界应继续改进研究方法、深化基础理论研究、把握刑事司法脉动、加强新型犯罪研究,为刑事法治事业再续新功。

Since 1978,with the gradual development and deepening of China＇s reform and opening up,the process of criminal legality has been developing rapidly. In the past forty years,the enactment and amendment of criminal code and criminal justice practice has interacted with criminal law research frequently and promoted each other. The introduction of foreign criminal law theory has added a new research path and broaden new areas of research for the criminal law research in China. The criminal law research has completed the historical mission of constructing theoretical system,deepening basic research,exploring new fields,and diversify research methods. In the future,we should continue to improve research methods,deepen basic theoretical research,grasp the pulse of criminal justice,strengthen the researches on new types of crime,and make new contributions to the cause of criminal legality.
