摘要
人工智能产品的质量问题如果不能妥善地解决,合同争议就会影响人工智能事业的发展。人工智能的制造商和服务商将在线服务获取的信息未经授权不当利用,甚至泄露个人隐私和商业秘密,将导致个人权益受损、法人经营损失,产生新的社会矛盾。可以预见,如果没有足够的法律资源去规范人工智能产品各方的权利义务,就有可能导致社会重大的混乱。通过合同将使用人、服务商、中间商等各自的权利义务固定下来,日后才不容易产生争议。在人工智能运用的时代,制造商和服务商必须尊重人工智能产品使用人的人格权,不得滥用因人工智能产品使用而获取的信息,未经权利人文字许可不得使用或转让使用这些信息。
If the problems of quality of artificial intelligence products cannot be properly solved,it will affect the development of artificial intelligence due to contract disputes. The personal interests and legal persons' operations will be damaged and lead to new social contradictions because the artificial intelligence manufacturers and service providers unauthorized use the information obtained by the online service,and even disclose personal privacy and trade secrets.It can be foreseen that if the existing legal resources do not suffice to regulate the rights and obligations of all parties involved in artificial intelligence products,it may lead to major social confusion. The rights and obligations of users,service providers and intermediaries shall be stipulated by contracts,in order to prevent dispute in the future. In the era of artificial intelligence,manufacturers and service providers must respect the personal rights of users of artificial intelligence products,not abuse the information generated by the use of artificial intelligence products,and may not use or transfer such information without the permission of the copyright owner.
