摘要
销量、信用评价等因素影响消费者的购买决策,在网络环境中,一些商家通过炒作信用行为,以刷单、刷好评等方式,提高声誉,从而获得消费者青睐。消费者在网购中不能像在实体店一样与商家"面对面"交易,只能通过商家单方面对商品信息的宣传来知晓商品情况。信息的不对称使得消费者的知情权很容易受到侵害。炒作信用行为危害极大,除立法上进行调整外,行政、司法诉讼等方面也应加强规制。
As factors like sales volume and credit evaluation can affect consumers' purchasing decisions in the network environment, some online dealers may improve their reputation to gain the favor of consumers by such hype credit behaviors as brushing orders and brushing praises. Unlike the physical stores for face-to-face transaction, when shopping online, consumers are informed only through the unilateral promotion of the dealers. Thus, the asymmetry of information makes consumers' rights to know vulnerable to infringement and the hype credit behavior is extremely harmful. In addition to legislative adjustments, the regulation of administrative and judicial proceedings should also be reinforced.
